Foke: Mereka Ngomel Karena Frustasi

REPUBLIKA.CO.ID,JAKARTA-–Gubernur DKI Jakarta, Fauzi Bowo mengatakan, menerima dan berterima kasih terhadap omelan dan cacian dari masyarakat lewat jejaring sosial seperti facebook dan twitter. "Saya terimakasih mereka 'ngomel', karena mereka frustrasi, tetapi yang jelas saya punya kewajiban yang saya kerjakan sesuai dengan rencana saya," katanya.

Ia mengatakan, jika ada warga yang kesal dengan kondisi banjir dan macet yang terjadi pada Senin, (25/10) diperbolehkan untuk mengajukan class action. “Saya kira hak masyarakat untuk melakukan gugatan publik, kita akan merespon,” katanya pada Rabu, (27/10).

Hanya saja, ia menegaskan, untuk mengajukan gugatan itu, ada klasifikasi dan kriteria yang diperlukan. “Tidak semua orang mengajukan gugatan publik begitu saja,” katanya. 

Sementara itu, Direktur Lembaga Bantuan Hukum (LBH) Jakarta, Nurkholis Hidayat mengatakan pihaknya sudah banyak menerima telepon dari warga Jakarta yang mengadu sebagai bentuk ketidakpuasan terhadap pemerintah terkait banjir dan macet besar pada Senin kemarin (25/10).

Ia mengatakan, banyak warga yang ingin mengajukan class action. Sebab, mereka merasa frustasi dengan kemacetan parah yang membuat mereka terjebak di jalan berjam-jam. “Mereka tidak percaya kepada pemerintah dalam menangani banjir dan memberikan pelayanan publik yang baik," kata Nurkholis.

Warga Jakarta ingin meminta pertanggungjawaban secara hukum dan memberi pelajaran kepada Pemprov DKI melalui pengajuan gugatan publik ini. LBH Jakarta sendiri belum melakukan gugatan resmi dan masih menerima masukan serta pengaduan dari masyarakat.

"Belum ada tindakan resmi gugatan. LBH Jakarta siap mendampingi dan memfasilitasi. Gugatan publik bentuknya gugatan biasa," tambah Nurkholis. Setelah itu, LBH akan membahas apa langkah hukum yang bisa diambil.

He said that if some residents upset with conditions of flooding and traffic jams that occurred on Monday, (25/10) are allowed to file a class action. "I think the public's right to conduct a public lawsuit, we will respond," he said on Wednesday (27/10).


However, he asserted, to file a lawsuit, there are classification and criteria required. "Not everyone who filed for the public just like that," he said.


Meanwhile, the Director of Legal Aid Institute (LBH) Jakarta, Nurkholis Hidayat said the company had received many calls from residents who complain of Jakarta as a form of dissatisfaction with the government related to flooding and major traffic jams on Monday (25/10).


He said many residents who wish to file a class action. Because, they feel frustrated with severe congestion that makes them stuck on the road for hours. "They do not trust the government in dealing with flooding and provide good public services," said Nurkholis.


Jakarta Residents want to hold accountable, legally and give lessons to the Jakarta government through a public filing of this lawsuit. LBH Jakarta itself has not made an official complaint and still receive feedback and complaints from the public.


"There has been no official action lawsuit. LBH Jakarta ready to assist and facilitate. The lawsuit claims its regular public," added Nurkholis. After that, LBH will discuss what legal steps could be taken.
